A group blog to promote discussion, debate and insight into the history, particularly religious, of America's founding. Any observations, questions, or comments relating to the blog's theme are welcomed.
Law law professor Akhil Amar is guest blogging at The Volokh Conspiracy. And he's taking on the Conspirators. He is arguably America's preeminent professor of constitutional law; therefore, his stuff is worth a careful read.
Isn't Amar's interpretation a way around the "rule of law"? Authority will still decide and/or determine what aspects of law will be defended. And "the people" (motivated by propaganda?) could sway the judiary as to the "unwritten constitution"! Isn't this a way to accomodate "God" in the cultural melieu of radical religionists? Then, where will America be? Our Constitutional government is a limited government, which is direct conflict with an expanded view of government via "God" (whether that is defined by Caesars/czars/kings or God ordained authorities)!

Here's the 9/7/12 Wall Street Journal Randy Barnett Book Review to which the Akil Amar guest blog is referring.
